RésuméʾAbū Saʿīd al-Siǧzī, astronome et mathématicien du ive/xe siècle, fut l'un des premiers auteurs du genre ʿilm al-hayʾa ; mais on connaît peu la genèse de cette discipline et sa relation aux autres écrits et pratiques en astronomie. Dans cet article, je présente de nouvelles découvertes permettant de préciser la biographie d'al-Siǧzī. Je décris ensuite, pour la première fois, une composition d'astronomie théorique du ive/xe siècle, la « Structure des orbes » d'al-Siǧzī, et je montre sa place dans la formation (...) de la discipline ʿilm al-hayʾa en comparant ce livre à l'ouvrage antérieur d'al-Farġānī sur la taille de la Terre et le nombre des sphères célestes. Je conclus que la Tarkīb al-aflāk d'al-Siǧzī est le plus ancien exemple connu d'un livre traitant des sujets abordés plus tard en hayʾa, et qu'il contient peutêtre la première occurrence du neuvième orbe céleste, classique dans les écrits du genre. Hasta el momento, la obra más conocida e importante del prolífico autor andalusí Ibn Saʿīd al-Maġribī (m. 685/1286) era su antología al-Muġrib fī ḥulà l-Maġrib (Lo extraordinario acerca de las joyas del Occidente). Sin embargo, igual en importancia debió de ser su homóloga oriental, al-Mušriq fī ḥulà l-Mašriq (Lo extraordinario acerca de las joyas del Oriente), obra de la que, por el contrario, se conoce muy poco. El propósito de este artículo es dar a conocer esta obra de Ibn Saʿīd, (...) dedicada a Oriente, así como el estudio preliminar de dos manuscritos inéditos del Mušriq, preservados en El Cairo. En él se tratan aspectos relativos a la composición de la obra, su autoría, su estructura y fuentes, y se ofrece una breve descripción de las principales características de ambos manuscritos junto con la información más relevante que contienen. This paper examines the debate on gender equality which is considered by some groups to be in conflict with Q.S. An-Nisa [4]: ​​11. With a philosophical approach and referring to the concept of inheritance of Sa'id Ramadan al-Buthi in the _Kitab_ _al-Mar'ah Bayna Thughyan al-Nizam al-Gharbi wa Lata'if al-Tashri' al-Rabbani_, this paper tries to refute these allegations and offers a more gender-friendly interpretation. For al-Buthi, the verse has actually liberated women because the provisions are caused by the responsibilities imposed by (...) Islam on men as prospective husbands and not experienced by women. On the contrary, if women are empowered than men, that is a moral responsibility, not a _sharia_ responsibility. Thus, women have been given freedom by the _sharia_ in order to determine the choice to participate in bringing about stability in life, regardless of the existence of a condition of women more empowered than men that will not be the cause of changes in the provisions of _sharia_ concerning inheritance. It is a known fact that interdisciplinary studies were valued in the past as well as today in the scientific world. As a matter of fact, the dimension of the relationship between Islamic law and Sufi sciences makes the books written by combining these disciplines more valuable. Gazali's Ihyâ and Şa'rânî's work named al-Mîzânü'l-Kübrâ are examples of books written in this manner. In Sâ'id b. Ahmed b. In Ebî Bekr el-Razi el-Hanefî's work “el-Cem'u Beyne'l-Fetvâ ve't-Takvâ fî Muhimmâti'd-Dîni ve'd-Dünyâ”, the relationship (...) between law and morality was compiled under the concepts of piety and fatwa. On the other hand, the fact that it was published as early as the sixth century AD further increases the value of the work. The work, of which there is only one copy in the world in the Kastamonu Manuscripts Library with registration number 935, was researched and published by Mehmet Sadi Çögenli, Mustafa Kılıçlı and Îd Fethî Abdullatif. We will criticize this book published by İrşad Publishing House in its original form. In this critique, which we will do with the aim of introducing the book to the scientific world, it would be appropriate to make a few evaluations regarding the investigation made while examining the book. Este artículo tiene como objetivo presentar un manuscrito conservado en la biblioteca de la Universidad de Bengasi (Libia) que contiene el Kitāb al-Ǧawhara fī nasab al-nabī ṣallā Allāh ʽalayhi wa-sallam wa-aṣḥābihi al-ʽašara por Abū ʽAbd Allāh Muḥammad b. Abī Bakr b. ʽAbd Allāh b. Mūsà al-Anṣārī al-Barrī al-Tilimsānī (596/1200-681/1282). Aunque ha sido mencionado en algunas publicaciones, no llamó la atención de los especialistas de la historia cultural de al-Andalus. Debido a la situación actual de la institución de conservación, no ha (...) sido posible ver ni ofrecer reproducciones. Aun así, como se cedió una fotografía para un catálogo, el último folio resultó muy útil. Se hace constar claramente el origen de la obra, que fue copiada en Menorca por su propio autor en el año 645/1248. Además, se puede observar que fue ofrecido como regalo a Saʽīd b. Ḥakam al-Qurašī, el gobernador de la isla, que fundó una biblioteca cuya riqueza fue celebrada por los autores medievales. En el estado actual del conocimiento, se trata precisamente del quinto manuscrito identificado, encontrándose hoy los otros cuatro en la Real Biblioteca del Monasterio de San Lorenzo de El Escorial. La historia del manuscrito permanece oscura, aunque se puede dar por establecido que reapareció en Libia a mediados del siglo XIX, siendo entonces propiedad de Muḥammad b. ʽAlī al-Sanūsī, fundador de la poderosa ṭarīqa al-Sanūsiyya. The biographical chapter presents Wright as an attractive character among devoted friends and also as a solitary, original scientist. Wright's primary achievement was to apply utilitarian principles to Darwinian natural selection theory. Since Darwin himself made no such attempt, nor did John Stuart Mill, and since Darwin showed an evident interest in Wright's attempt, this represents (...) a major contribution to evolutionary theory. On the negative side, too, Wright was incisive in his criticisms of Spencer, Mivart, Hamilton, Mansel, and Lewes. The pragmatic strains in Wright's philosophical method were incidental to his primary interest in showing that sciences are metaphysically "neutral." But his influence on Peirce and James was direct and strong, both on their cosmological and methodological doctrines. He deserves to be mentioned as the prime mover in this trinity of early pragmatism and naturalism, but since his own writings were relatively few and scattered, his historical importance rests largely on the use which Peirce and James made of his ideas and the development which they gave to his philosophy. Mulla Sadrā refers to ancient Greek philosophers in his writings quite often, especially when the subject matter is the soul. In this article, I will address how Mulla Sadra reiterates Avicenna’s summary and analyses of ancient theories of the soul as discussed in Safar 4, Bab 5, and Fasl 5 of, al-Hikmat al-Mutaʿāliya fi asfār al-ʿaqliyyat al-arbaʿa. The source of these discussions, when the structure and basic contents are considered, is Aristotle’s De Anima Book I. Before defining the soul, Aristotle (...) discusses what kind of a science, a science on the soul should be, and afterwards, he evaluates previous theories on the soul as those defining the soul through movement, perception, and life. We observe that this evaluation on previous theories play a preparatory role for his own definition of the soul as perfection and actualization. In a similar manner, in Safar 4, Bab 5, and Fasl 5 of Asfār al-aqliyyat al-arbaʿa, Mulla Sadrā reinterprets and discusses Ancient theories in such a way that the discussion leads us to a theory similar to Mulla Sadrā’s. In the presentation of this chapter, we find out that the soul is immaterial and modulated (tashkīkī) reality and is represented as a unity which is in a constant movement in its substance. The soul is matter in its origin, yet turns into an immaterial reality through substantial movement. In direct disagreement with Aristotelian philosophy, for Mulla Sadrā, movement in substance is possible as well as it is essential in understanding the reality of the soul. When Mulla Sadrā evaluates the ancient discussions and the criticisms by Avicenna, he finds that the discussion focuses on the source of mobility yet the soul is supposed to be defined as the source of immobility equally. Next in the discussion on movement, he focuses on the necessity of accepting the principle of substantial movement. According to Mulla Sadrā, Avicenna (following Aristotle’s presentation and interpretation) is misleading in his evaluation and criticisms of the ancient theories on the soul mainly because he follows a literalist reading. On the contrary, sources for Ancients’ knowledge is perennial wisdom, and their words on the soul have deeper meanings than what is understood at the first reading. When read with more trustful lenses, it will be manifested that the soul is an immaterial reality for them as well. For example, when they talk about the soul as a sphere, Mulla Sadrā thinks that they want to direct attention to the perfection. When fire is mentioned, the dynamic reality of the soul is brought to light. Mulla Sadrā, adds the principle of gradation (tashkīk) to his presentation and talks about modulation of fire from material fire to the immaterial light (nūr).The lowest level of fire is related to the changes in nature of the soul, the soul responsible of irascible and concupiscent establishes the next level. Once the soul is under total control, then it completes the passage to its incorporeality and becomes light. So this chapter is important in its structure because it allows us to read into how Sadrā’s historical reiteration is influenced by his own theoretical framework on the one hand. On the other hand, thanks to the long lineage of De Anima commentary literature, we can compare Sadrā with Aristotelian readings in this chapter. The interpretative reading of Mulla Sadrā, in opposition to the literalist reading of Avicenna on the ancient theories, also leans on a history of other philosophers before him. In this regard, a lineage of historiography might be traced back to Āmirī, Qādi Saʿīd, and Shahristāni. What the article comes to conclude is that a particular presentation found in Aristotles’ De Anima- Book I is molded in Mulla Sadrā’s hands with a more interpretative version of pre-Socratic theories to such an extent to support Mulla Sadra’s own theories on the soul. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. IIabIb, nos permiten precisar mejor la interpretación "paradisíaca" de Madinat al-Zabrá' y dotarla de sentidos concretos, mostrando sus ventajas sobre otras posibles (aunque no deseebables). Se explica así no sólo la variedad, sino también la asimetría, de las decoraciones parietales del Salón de 'Abd al-Ralimán III, se da sentido a cómo pudieron surgir una serie de relatos en tomo a (...) Madinat al-Zabrá', se puede plantear una nueva interpretación de la decoración en "verde y manganeso" de la cerámica producida en la ciudad y se sugiere otro aspecto más del nombre por el que ésta fue conocida. También se puede establecer una relación con una de las doctrinas atribuidas a Mundir b. Said al-Balítití, cadi de 'Abd al-Ralimán Itt desde 339/950 basta la muerte del califa. El silencio de las fuentes árabes sobre ese simbolismo paradisíaco puede ser puesto en relación con la anécdota de cómo ese mismo MuÑir b. Sa'id censuró la actividad constructora de 'Abd al-Rahmán III. Por último, MadInat al-Zabrá debe ser estudiada siempre dentro del contexto del enfrentamiento político-religioso con los Fatímíes y, más en concreto, con la situación surgida a partir de la derrota del "Hombre del Asno", presentado como figura escatológica (al-Dayyal) por los Fatimies. As mentioned in the narrations, the messenger of Allah (pbuh) used to recite some prayers known as opening prayers such as Subhaneke, Wejjehtu and Allâhümme Bâid before reciting Fatiha surah while starting the obligatory and supererogatory worships (salat). In this study, it is aimed to find out the reflections of the abovementioned prayers in narrations, and to determine their authenticity and to reveal the reasons why jurisprudential sects preferred different prayers. Benefitting from literature review method, hadith inferences were made, and (...) moving from the books of refutation & corrections and biographies, the cases of the narrators of the hadiths, who took part in the ascription of the narrations, were put forth. After the investigation, it was determined that the narrated narrations about Subhaneke, an opening prayer, were found to have been narrated by eight different prophet companions in their later works through Aisha and Abu Sâ’id al-Khudrî in early hadiths resources; and that all these narrations were week in terms of authenticity. However, it was revealed that the most authentic narrations about the issue were those depending on the practice of Umar. In the hadith resources, it was seen that five different prophet companions narrated some narrations about the Wejjechtu prayer, and that the great majority of these narrations were through Ali, and that most of these narrations were authentic, yet only one reference was found to be weak. On the other hand, it was revealed that the narrations narrated by Abu Huraira between the opening prayer, Allâhümme Bâid, turned out to be genuine in terms of authenticity. For instance, while Hanafis and Hanbalis have preferred reciting Subhaneke during salat, Shafiîs have found it appropriate to recite the prayer Wejjectu in the salat. On the other hand, Malikis have thought that it was obligatory to start the salat with Surah Fatiha, and that it was makruh to recite these prayers in salat. (shrink)

La vida y obra del polígrafo granadino Lisān al-Dīn Ibn al-Ḫaṭīb (m. 776/1374) sigue siendo fuente de importantes estudios y traducciones habida cuenta de que su prolija producción literaria está repleta de valiosos testimonios históricos y personales que sitúan a su autor como un personaje destacado en la transmisión del conocimiento en el Mediterráneo islámico. En la difusión de su obra y prestigio jugó un papel fundamental la copia manuscrita de su obra al-Iḥāṭa fī aḫbār Ġarnāṭa que Ibn al-Ḫaṭīb envió (...) en vida (768/1366), a través de su hijo ʿAlī, a la ḫānqāh de Saʿīd al-suʿadāʾ de El Cairo, regida por el tremeceno Ibn Abī Ḥaǧala (m. 776/1375). El conocimiento de esta copia ha llegado hasta nosotros a través de otro tremeceno, al-Maqqarī (m. 1041/1632) y su monumental obra, Nafḥ al-ṭīb, en honor al sabio granadino. Gracias a ella sabemos, entre otras cosas, que esta copia fue profusamente consultada y comentada en sus márgenes. Dos autores destacan por encima de los demás: el hijo del autor Abū l-Ḥasan ʿAlī (m. s. IX/XV), y el magrebí Ibn Marzūq (m. 781/1379). A través del estudio y la traducción de las notas manuscritas de este manuscrito cairota, este estudio pretende poner de relieve el valor de los marginalia como fuente documental, así como arrojar un poco más de luz sobre estas dos figuras, junto con al-Maqqarī, como piezas importantes en la transmisión y pervivencia de la obra de Ibn al-Ḫaṭīb en el Oriente islámico hasta al menos el siglo XI/XVII.
